Sales Terms and Conditions

  TERMS & CONDITIONS

Australis Floors |  www.australisfloors.com.au

  1. Goods and Services

All goods and services supplied by Australis Floors are subject to these terms. Title in goods does not pass to the customer until payment is received in full. Risk in goods passes to the customer upon delivery.

  1. Australian Consumer Law (ACL)

Our goods and services come with guarantees that cannot be excluded under the Competition and Consumer Act 2010, Schedule 2 (Australian Consumer Law). For major failures, you are entitled to a replacement or refund and compensation for any other reasonably foreseeable loss or damage. For failures that do not constitute a major failure, you are entitled to have the goods repaired or replaced within a reasonable time.

  1. Warranty

Where a warranty is provided, it applies in addition to, and does not limit, your rights under the ACL. Warranty claims must be submitted in writing to Australis Floors within the warranty period specified at the time of sale.

  1. Cancellations & Returns

Cancellations must be made in writing prior to delivery. Returns will only be accepted where goods are faulty, not as described, or where required under the ACL. Australis Floors is not obliged to accept returns for change of mind. Where a return is accepted outside of ACL obligations, a restocking fee may apply.

  1. Limitation of Liability

To the maximum extent permitted by law, Australis Grass limits its liability for breach of any non-excludable guarantee under the ACL (where applicable to goods not ordinarily acquired for personal, domestic, or household use) to: (a) replacement or re-supply of equivalent goods; or (b) payment of the cost of replacing or acquiring equivalent goods.

  1. GST

All prices are inclusive of GST unless stated otherwise. A valid Tax Invoice will be issued for all taxable supplies made by Australis Grass as required under the A New Tax System (Goods and Services Tax) Act 1999.

  1. Debt Collection

If any amount remains unpaid after the due date, Australis Floors reserves the right to take the following action without further notice:

(a) Engage a third-party debt collection agency to recover the outstanding amount. The customer agrees to be liable for all reasonable costs incurred in collecting the debt, including collection agency fees and legal costs on a solicitor-client basis.

(b) Suspend or withhold the supply of any further goods or services until all outstanding amounts are paid in full.

(c) Report the overdue account to a credit reporting body in accordance with the Privacy Act 1988. Customers will be notified before any such report is made.

(d) Register a security interest over any unpaid goods under the Personal Property Securities Act 2009 until full payment is received.

The customer acknowledges that any costs associated with debt recovery, including but not limited to legal fees, collection agency commissions, and court filing fees, are a debt owed to Australis Floors and recoverable accordingly.

  1. Disputes

In the event of a dispute, the parties agree to first attempt resolution in good faith. If unresolved, disputes may be referred to the relevant state consumer protection authority or the Australian Competition and Consumer Commission (ACCC).

  1. Governing Law

These terms are governed by the laws of Australia and the relevant state or territory in which the transaction occurs.
